The appeal by the civil parties against the acquittal of Fabiano Maria Saba, the only suspect until last March on charges of manslaughter and concealment of a corpse in the death of Antonio Masia , found lifeless on July 25, 2022, in the Gesam factory in Truncu Reale, was rejected today in the Court of Appeal in Sassari in the civil proceedings.

The panel, chaired by Maria Grixoni, with Cinzia Caleffi and Cristina Fois acting as associates, rejected the request, ordering the appellants, represented by attorneys Daniele Alicicco and Francesca Fiori, to pay costs. Saba, a worker at the Truncu Reale plant at the time, was represented by Luca Sciaccaluga and had been acquitted by preliminary hearing judge Sergio De Luca in March, as requested at the time by prosecutor Maria Paola Asara.

And the Public Prosecutor's Office itself chose not to appeal the judge's decision. Both Masia and Saba were employees of the facility that was destroyed by fire a few days after the man's body was found.

During the discussion seven months ago, several doubts arose regarding the circumstances surrounding the death, both regarding the time of death, which the coroner changed by two hours from what was previously believed, thus proving Saba's absence at the scene, and the presence of three vehicles, including a forklift and a blackbird, two more than initially assumed.

Even at the location where Masia was found—the plastics sector—there are no certainties, according to lawyer Sciaccaluga. This is because the messages addressed to the man were very late in arriving, despite there being regular cell phone coverage in that area.
