A school-breaking decision.

The judge of the Sassari court Valentina Nuvoli has ordered the preliminary ruling to the European Court of Justice of a question relating to the citizenship income received by a Nigerian woman who lives in Sassari.

The lady is accused of having made false declarations to obtain the support measure, in particular on the condition of ten years of residence, which she did not have, to access the measure she received between 2020 and 2021 and then suspended.

But on this point her lawyer, Giuseppe Onorato, instead raised an exception, for the first time in Italy, referring to European legislation and the refugee status of the 31-year-old who received political asylum.

Given its status, in fact, those ten years established by Italian law could now be considered a discriminatory rule according to the provisions in force in the Old Continent.

Now, pending the Court's decision, the criminal trial has been suspended.
