The preliminary hearing judge of the Tempio Pausania Court, Marcella Pinna, acquitted the captain of the Delcomar ferry "Isola di La Maddalena," Giuseppe Esposito, and the boatswain, Fabio Sirena, of the charge of risk of contamination. Following a summary trial, Esposito and Sirena were cleared of charges for the events that occurred on the morning of August 9, 2024, in the port of La Maddalena .

The defense attorney, Pierfranco Tirotto, demonstrated that the two bear no responsibility for the accident that caused approximately 18,000 liters of diesel fuel to spill onto the dock and into the sea . The fuel leaked from the tank of a tractor-trailer due to the impact of a metal bar on the vehicle's frame. Therefore, no liability can be attributed to Esposito and Sirena; there were no errors in the maneuvers of the cars and trucks exiting the Delcomar ferry.
