The prosecution's arguments for the civil party were fully accepted , and therefore the judges fully accepted the victim's position and requests , considering her "fully credible, because her statements were corroborated".

This is the first element that emerges from the 72 pages of the reasons for the sentence for gang rape issued in September against Ciro Grillo, Vittorio Lauria and Edoardo Capitta (eight years) and Francesco Corsiglia (six years and six months) .

All the elements presented by the lawyer Giulia Bongiorno were fully accepted by the panel of the Tempio Tribunal , presided over by Marco Contu with associate judges Marcella Pinna and Alessandro Cossu : reconstruction, dynamics of the facts, the psychological element considered well-founded.

Among the elements considered central are the statements made by the girl to several people immediately after the gang rape . "They all raped me," she reportedly said immediately after the incident to her friend, another friend, her mother, and the kitesurfing instructor.

"SPECIAL BRUTALITY" – Furthermore, according to the judges, Ciro Grillo and his three friends acted "with particular brutality" toward the 19-year-old Italian-Norwegian student who subsequently reported them. Specifically, in connection with gang rape, not only Corsiglia but also the other three men were convicted because, according to the girl's testimony and upheld by the judges, the three men allegedly prevented her from leaving, thus acting as an obstacle and participating in the incident.

The state of impaired defense was also accepted , based on the victim's statements: the young woman reportedly stated that she was drunk and therefore in a vulnerable position with the four who allegedly took advantage of her.

As regards the Count b of the indictment , the incident reported by the 19-year-old student's friend with a sexually explicit photograph and video taken by the boys while she was sleeping on the couch, also contains evidence of physical contact, and the judges therefore found sexual assault. There was "a predatory climate in that house" with "violent and insidious conduct by all participants , unequivocally aimed at forcing group sexual acts on an unconscious girl , in the same context in which a further sexual assault was taking place, which they were witnessing," the judges wrote, explaining the reason for this conviction.

THE RECONSTRUCTION – In the 72 pages filed, the judges recounted the incident that took place in July 2019 at Beppe Grillo's residence on the Costa Smeralda . That evening, Ciro Grillo and his three friends, Edoardo Capitta, Vittorio Lauria, and Francesco Corsiglia, after meeting the 19-year-old student and a friend, invited them to the residence. According to the judges, this is where the gang rape took place.

"The panel reiterates the full credibility of the injured party, who, contrary to the defense's claims, has, from the beginning, given an essentially unchanged account. The alleged contradictions highlighted by the defendants' defense should be considered nothing other than physiological and due to the victim's difficulty recalling countless details of an incident dating back several years to her testimony at trial," the judges write. "Regarding the violent nature of the sexual encounters," they continue, "the victim's description certainly excludes any possibility of consent on her part, given that they occurred in a context of constraints and the girl's inability to react, which demonstrate the particular brutality of the group, united from the beginning, and which acted in a predatory and domineering manner, with no consideration for the girl's fragile state."

Defense lawyers Enrico Grillo, Andrea Vernazza, Alessandro Vaccaro, Ernesto Monteverde, Mariano Mameli, Gennaro Velle, and Antonella Cuccureddu are now preparing to appeal.
