Sergio Mattarella promulgates the milleproroghe decree with reservations and calls for "government and Parliament initiatives to correct the rules on bathing establishments" .

On state concessions, writes the Head of State to the presidents of the Chambers, "it is clear that the profiles of incompatibility with European law and with jurisdictional decisions increase the uncertainty of the regulatory framework and make further government and Parliament initiatives indispensable in the short term ».

For Mattarella "it will be necessary to ensure the application of the competition rules and the protection of the rights of all the entrepreneurs involved , in accordance with Union law, as well as guarantee legal certainty and the uniform application of the law towards the subjects public and private entities operating in this area".

He then continues: «Finally, I note that article 1-bis, paragraphs 1-6, as can be seen from the quantifications of the same technical report, contains insufficient financial coverage in a time projection which, in order to ensure full compliance with the article 81 of the Constitution, must be integrated with the first useful legislative measure».

Mattarella had already expressed doubts about the new rules on state concessions in recent days. Not so much for the flat extension of the concessions for one year , in defiance of the Bolkestein directive. But above all for all the rules that act as a corollary, including those that would allow further postponements of tenders until 2025 under certain conditions .

Criticisms were also raised by the Head of State on the very heterogeneous nature of the provisions contained in the decree: «It contains – reads Mattarella's letter – 205 additional paragraphs compared to the original 149 . It is quite evident that, since these are provisions which, by their nature, pertain to different and heterogeneous material fields, when the unifying ratio, represented by the regulatory requirement of a temporal nature, is lost, they are transformed into completely inhomogeneous omnibus decree-laws , that is to say in mere containers of the most disparate regulatory interventions ».
