The Court of Cassation has overturned and remanded the second appeal ruling that sentenced Davide Fontana to life imprisonment: this reopens the trial for the third time at second instance against the 45-year-old banker who, on January 11, 2022, killed and dismembered Carol Maltesi, originally from Sesto Calende, in the home in Rescaldina where she lived.
The Supreme Court of Cassation found the second-instance trial's reasoning insufficient on one specific point: the aggravating circumstance of premeditation. La Prealpina reports.
The Supreme Court had already reopened the case, adjourning it for a second appeal. This also resulted in a life sentence for Fontana. Yesterday, the case was adjourned again, resulting in a third trial before the Milan Court of Appeal.
Fontana, a self-confessed criminal, murdered his neighbor (they lived in the same courtyard) when he discovered she was moving to Verona to be near her six-year-old son, who lives with his father in Veneto.
He did so by beating her with a hammer, then killing her with a slash to the throat and dismembering her body. After attempting to burn the remains, he abandoned them in the Brescia area.
