The young man, 18 years old, is called Michele Di Rosa : he turned himself in in Monza, explaining that he was one of the boys responsible for setting the deadly trap. He was taken to prison, again in Monza, and now the investigators are tracking down the third boy, already identified .

« It was a game without rules , there was no pre-established height at which we intended to place the cable, in general there was no planning of the thing, but only 'take the cable and pull it', I didn't realize the real danger. It shouldn't have been a trap, it was our game that shouldn't have involved anyone else ." These are the words of Alex Baiocco, the first arrested, a 24-year-old from Milan, in the interrogation given to the investigating judge Domenico Santoro.

“We had been drinking, we were bored and we came up with this stupid idea,” he said. «When we saw that someone was watching us from the window (the one who called the police, ed.) we ran away scared. This is what I regret, because then I realized that the cable had to be removed, I understood that someone could get hurt or that it would in any case hinder the passage. Only in the cell did I reflect and understand that someone could die ."

Baiocco said he was acting "the clown to please his friends", he felt "participant in the group" and he "needed approval".

The investigating judge defined the conduct of the young people as "absurd" . Conduct which, as stated in the ordinance, " does not constitute the crime of massacre which consists in the fact of those who, with the aim of killing, carry out acts which endanger public safety, understood as the good of safety of life and physical integrity , referring not to one or more specific persons but to the community as a whole".

In this case, we read further in the provision, " it is not possible to deduce that that conduct was accompanied by the aim of killing in the sense required " by the jurisprudence.

The same applies to the accusation of violating transport safety. Instead, "in the current state of the documents, it does not appear doubtful that the very dangerous device objectively had the purpose of obstructing free road traffic". The crime in question is therefore a road block.
