A Coast Guard patrol boat departed from Brindisi and docked in Gjader, Albania, where the twelve migrants from the Italian repatriation detention center will soon leave the facility to return to Italy . Yesterday, the immigration section of the Rome court did not validate their detention inside the center.
In the next few hours the migrants will board the patrol boat headed to Bari, where - as we learn - they will be welcomed in the Reception Center for Asylum Seekers in Bari . The vessel that will transport them will therefore not be a military ship, as was initially learned.
Giorgia Meloni is furious about the court's decision. " A specious and arrogant act that seeks to block government action ." A "prejudicial" decision by the magistrates who rejected the transfers of the first migrants to centers in Albania. A protocol that Italy aims to make a European model, supported by the President of the Commission herself, Ursula von der Leyen. And which was meant to lend itself to the narrative of a great success in the new course of migration policies.
To remedy the situation , Meloni announced new rules in the Council of Ministers on Monday (aiming, among other things, to speed up the examination of asylum applications and, perhaps, to review the appeals mechanisms) . The new rules will have to reiterate – in legal terms – that it is up to the government, not the judges, to indicate which countries are safe. Otherwise, according to the reasoning at the highest levels of the executive, no action to combat illegal immigration will be possible. In essence, it will be impossible to implement a "border defense policy."
The executive speaks of a "forced action", an action "that goes beyond the limits and overrides the prerogatives of the government and Parliament". That the decision is "prejudicial", says the prime minister herself, "is demonstrated by the fact that some of these judges had criticized the agreement with Albania even before entering into the merits.
The opposition, for its part, attacks and Schlein speaks of "damage to the treasury", denouncing "the illegal agreement made with Albania, an agreement that violates international law . The entire mechanism - he says - is not sustainable. It is a question of 800 million thrown away that could have been used for healthcare".
There were sixteen migrants brought by a Navy ship to Albania , based on an agreement between Rome and Tirana. The first four were immediately returned to Italy because they were minors or had health problems. Yesterday the Court ordered the return to Italy of the other twelve because "the two countries they come from, Bangladesh and Egypt, are not safe, also in light of the ruling of the Court of Justice" .
