«The facts of procedural interest occurred in the presence of conditions that are no longer present or repeatable».
This was written by the judges of the first section of the Court of Cassation in the reasons for the sentence of February 25th, which confirmed house arrest for Chiara Petrolini, the 21-year-old from Traversetolo accused of killing and burying her two children in the garden of the house where she lives in Vignale, in the province of Parma.
The supreme judges have annulled with referral, to order a new trial, the order of the Review Court which, in accepting the appeal of the Prosecutor's Office, had ordered the prison sentence for Petrolini who is currently under house arrest.
In its reasons, the Court of Cassation recognizes that the defendant has a "very high capacity for deception and an uncommon criminal determination" but, justifying the confirmation of house arrest, explains that Petrolini "was able to commit the very serious crimes attributed to her because she was capable of establishing and cultivating a rich and complex life of relationships and affections which - it is stated in the 14-page document - would, instead, be necessarily inhibited under house arrest".
For the Supreme Court judges, "in other words, the concreteness of the possibility that Petrolini knows someone - who, as happened with Samuel Granelli, father of both deceased children and linked to her for years - receives in the house and with whom she procreates other children to then kill them and suppress their bodies, must be tested in direct relation to the restrictions connected to house arrest which, as far as is known, does not entail, in this case, the right to leave the home, even temporarily ".
