The story of Sara Cunial, the deputy (former M5s and now Misto) no-vax who managed to snatch a suspension from the obligation of a Green pass to enter the Chamber is still being discussed.

His special permission to access Montecitorio without vaccine or tampon (which in fact makes it the only one in Italy to be able to go to work without showing the green certification) will end next Thursday, with the session of the Montecitorio Jurisdiction Council which will re-establish for her the rules that apply to everyone.

But in the meantime, the Democratic Party asks for the resignation of Andrea Colletti, the president of the Chamber of Appeal who, with his own monochratic precautionary decree, accepted the request for precautionary suspension presented by the deputy of the Mixed group of the resolution with which the college of Quaestors introduced the requirement of a pass to access all the offices of the Chamber, as has been the case since 15 October for all workplaces in the country.

Colletti said yes, he explained, "both because I felt that there was a 'periculum' of damage to my colleague's right to carry out parliamentary activity, and because I believe there is a 'fumus boni iuris' on the Quaestors' resolution , which has a strong constitutional criticality ".

A Colletti, a no pass deputy for Alternativa, is reproached by the other parliamentarians for having violated the procedures. According to Quaestors and dem, he should have waited for the Jurisdictional Council, ie the first instance, to deal with the complaint.

But there are no tools to force him to take this step, given that the Appeals Council is not a political body but a jurisdictional body, precisely the appellate court. "I do not intend to reply to politicians who want the resignation of third-party judges. The removal of judges unwelcome to parties in power is prohibited by the Constitution," Colletti replied.

Meanwhile, the Council of jurisdiction will meet on Thursday, chaired by Alberto Losacco (Pd), and here Cunial's appeal should be rejected. It was not possible to anticipate the session, explained Losacco, to respect the procedures and avoid appeals on this aspect. In the meantime, the Quaestors already issued a further resolution on Thursday evening which, as the senior Quaestor Gregorio Fontana explains, "limits the damage": Cunial will be able to enter to perform his role as parliamentarian, but in a seat in the stands, through a predetermined route. From there he will not be able to move, going to the hemicycle or to the other areas of Montecitorio.
