The case of forfeiture erupts once again in the Regional Council Chamber.
Yesterday, after the green light to the bill for the implementation of the Save Home, a motion signed by the majority group leaders was passed that commits the Council to raise a conflict of attributions between entities before the Constitutional Court. In practice, an appeal against the ruling of the civil court of 22 May that rejected Alessandra Todde's appeal against the injunction order of the electoral college of guarantee.
The motion was not even discussed. The minority abandoned the proceedings as soon as the President of the Regional Council Piero Comandini brought it to the attention of the Chamber. Thus, in a few seconds the text was given the green light. A blitz, which was not necessary, considering that it is the prerogative of the Executive alone to propose appeals for conflict of powers.
This would be the second one raised before the Constitutional Court for the same region. The first was proposed by the Regional Attorney's Office, again on behalf of the Council, against the same injunction order of the Panel established at the Court of Appeal that asks the Sardinian Assembly to declare the dismissal of the President of the Region for alleged irregularities in the electoral report. The Constitutional Court has already set a first hearing for July 9 to discuss it.
Now, once the Council has deliberated, it is also possible that the Court will decide to examine the two appeals at the same time, and for this reason it could perhaps postpone the hearing date. Even the latest initiative is part of the more general strategy of the governor's defense team, that is, to gain time. The team, in the meantime, is also preparing the appeal against the sentence of the first-instance civil court.
