According to the lawyer, it is necessary "to declare, pursuant to articles 7, letter c, and 24 of legislative decree 1 of 2018, the state of emergency resulting from the combined calamitous phenomenon represented by the war in Ukraine, the diplomatic crisis and the induced energy crisis that unloads unsustainable costs on entrepreneurs and families in the short and medium term ".

The provision, continues Arbau, " would allow the public coffers to extend all the deadlines for energy bills by 12 months up to the end of September 2023 and with deadlines until 2024, at no cost. to allow an orderly installation of the new government, to verify international diplomatic developments, to take note of the impact that the lack of Russian gas supply has on the European production system and, above all, to find a legal and financial instrument that definitively sterilizes the disproportionate increase and unsustainable of the energy bill ".

The proposed mechanism, the letter reads, has already been “tested, in limited territorial areas, in the case of calamitous events such as earthquakes. The effect would be to avoid recession, save businesses from bankruptcy, workers from job loss and families from disaster . For energy-intensive companies that in recent months have, throughout the European continent, forfeited significant extra profits, the risk and exposure would in any case be limited, given that it is a postponement of the terms and not the cancellation of credits ".
