The Brescia Public Prosecutor's Office is insisting on the bankruptcy of Massimo Cellino 's Brescia Calcio , while the defense of the former Rossoblu president is attempting a last-ditch effort to avoid the liquidation of the company by filing a "blank" application for preventive composition, which will subsequently have to be integrated with the plan and documentation required by law.
Before the court, Public Prosecutor Jacopo Berardi reiterated the club's request for bankruptcy, burdened by over €20 million in debt . The defense's new initiative comes after the reactivation of the federal register, which would allow the club to restart from the lowest division of Italian football, and replaces the previous negotiated resolution procedure.
Also weighing on the proceedings is the final report by lawyer Eugenio Biscoli , the expert appointed by the Court to follow the negotiated settlement, who expressed a strongly critical opinion on the company's actions .
According to the expert, Brescia "failed to respect the principles of good faith and fairness" during the procedure, highlighting the lack of a concrete and actionable proposal for creditors and complaining of a lack of transparency in its relationships with the expert and other parties involved.
Cellino's defense is now relying on a preventive settlement agreement to keep the club afloat and manage its debt restructuring. The Prosecutor's Office, however, believes there are no grounds to avoid bankruptcy. The Court's decision is expected after the additional documentation required for the new procedure has been filed.
