The Constitutional Court is scheduled to examine today the constitutional issues regarding the law on differentiated autonomy raised by the appeals presented by the Region of Sardinia and the Regions of Puglia, Tuscany and Campania, which have challenged the law in its entirety and also with reference to specific provisions.
The questions submitted to the Court for examination, in particular, are linked to the interpretation of Article 116 in relation to the attribution to the regions of further forms and particular conditions of autonomy.
Some of the issues concern the determination of the LEP (essential levels of performance concerning civil and social rights that must be guaranteed throughout the national territory) both with regard to the source and the determination procedure, and with regard to the identification of the subjects and the transfer of functions.
Other issues concern the approval procedure of the agreements between State and Region for the attribution of the subjects and the relative functions. Others still involve the methods of financing the transferred functions.
On many issues raised by the Sardinian government of Governor Alessandra Todde and by the governments of Puglia, Tuscany and Campania – branded center-left – the regions of Piedmont, Veneto and Lombardy , led by the center-right, have presented opposition. The Court will decide on the admissibility of their interventions.
