Eitan's maternal grandfather, the child who survived the Mottarone massacre and now disputed between the two families, filed an appeal with the Tel Aviv District Court against the sentence of the Family Court which recognized the reasons of Aya Biran - the child's paternal aunt - under the Hague Child Abduction Convention.
This was announced by Gadi Solomon, spokesman for Shmuel Peleg's family. The appeal complains that the Court did not take into account "the exceptional circumstances it faced" and ignored "the unilateral actions of aunt Aya Biran". Who "with cunning" would have "acted behind the Peleg family while they were in mourning to obtain protection" of Eitan.
"Even in recent days - continued Solomon - he has continued to violently violate the temporary agreements relating to Eitan's stay between the two families in Israel and thus has shown that he prefers his own interest to that of Eitan". According to Shmuel Peleg's lawyers "there is no reason for the debate on the future life of Eitan - an Israeli citizen whose family members on both sides are in Israel and speak Hebrew - to take place in Italy". "The impression was created - he concluded - that whoever insists on this happening is motivated by extraneous reasons".
The appeal actually blocks, according to legal sources, the effectiveness of the sentence of the Tel Aviv Family Court which had in fact ordered the return of the child to Italy in 15 days.
Now it will be up to the Court to decide whether or not to grant the appeal. Meanwhile, the little survivor of the Mottarone tragedy will have to stay in Israel for now.
