The case is unprecedented: the removal of a regional president that causes the dissolution of the entire regional council and a return to elections.
Since the provision of the Electoral Guarantee College was notified, the most disparate hypotheses have been made. Up to the decision to follow the double track that passes through the Election Committee of the Regional Council and the appeal of the governor Alessandra Todde to the ordinary court . But a third way remains standing, which however does not exclude the other two: the Constitutional Court.
From the very beginning, given the exceptional nature of the specific case, many thought that only the judge of the laws could have clarified. Some still believe it, considering that the Region does not exclude raising a conflict of powers with the State, on which the Consulta is competent to judge. In practice, this is the starting thesis, the law of the State applied by the College of Guarantee would harm the prerogatives of the Region. And a Regional Council can raise the conflict of powers when it believes that other organs of the State or other Regions have violated its competences. This could be the case.
