The Council of Ministers contests numerous passages of the Sardinian law: the reintroduction of six provinces and two metropolitan cities is also under scrutinyPer restare aggiornato entra nel nostro canale Whatsapp
The Council of Ministers challenged the Financial Statement, approved by the Regional Council in September and published in Buras at the end of October, before the Constitutional Court .
Two laws were brought by the Government to the Council (34 were uncontested), during the meeting at Palazzo Chigi. One is from Puglia, the other is the Sardinian text which was supposed to be for "legislative maintenance" and instead contained 139 articles which concerned numerous sectors, from the implementation of the (re)establishment of the new provinces (six plus the two metropolitan cities of Cagliari and Sassari), to funds for the financing of airlines, including urban planning and healthcare.
It has not yet been made known which part of the law was contested, on the proposal of the Minister for Regional Affairs, the Northern League member Roberto Calderoli.
The note from the Council of Ministers states that "certain provisions" of law 9 of 2023 go beyond "the statutory competences" and are "in conflict with state legislation on the environment and landscape, civil order, public order and safety, production, transport and distribution of energy, health protection, coordination of public finance, territorial governance and territorial planning" and "violate articles 9 and 117, first and second paragraphs, letter. h), l) and s), 117, third paragraph and 133, second paragraph, of the Constitution".
Therefore, there appear to be numerous areas of the Connected matter that the Government has decided to bring before the Court . The reference to article 133 of the Constitution suggests that the Provinces, or the method of their rebirth, are also a subject of conflict. But to be certain it will be necessary to wait for notification of the appeal, which should take place in the next few days.
This is the nineteenth Sardinian law challenged by the Government since the beginning of the legislature.
