After the ok for the PA , the agreement between the government and the social partners on smart working in the private sector for the post-pandemic period is getting closer and closer.

The draft agreement was presented by the Minister of Labor, Andrea Orlando, who asked the parties to receive their comments as soon as possible so that the game could be closed by the end of next week.

The document provides for the possibility of an individual agreement between employer and employee, in which the duration of agile work, the alternation between periods of work inside and outside the office, the places where it will be forbidden to perform the service, work tools, rest times, control methods and training activities.

The draft we are working on is based on the idea that there will not be a specific working time, but the tasks will be carried out independently by the worker, for which a time band will be identified for disconnection (the employee will not be constantly available but will have the right to "disconnect").

It will still be possible to request all the permits provided for by the collective agreements and linked to the enjoyment of Law 104 but overtime will not be paid.

In the event of illness, vacation or accident, the worker can deactivate the company devices and will not be required to respond to company communications before the scheduled resumption of work.

The IT tools will be provided by the employer, who will also be responsible for the costs of maintenance and replacement of the devices, unless any damage has been caused by negligent behavior on the part of the employee (in this case they will be charged for costs).

The agile worker will be entitled to the same economic and regulatory treatment as workers who do not use smart working, also for performance bonuses.

The draft agreement was promoted by the trade unions. The confederal secretary of the CGIL Tania Scacchetti spoke of a "good balance in the discussion". "We believe that the text - explained the confederal secretary Uil Tiziana Bocchi - represents a point of balance between the various requests, especially where there is a reference to collective bargaining, which has already identified innovative paths and solutions in recent months".
