The ranking from the Ares technical commission was clear: they were unfit for active duty for major codes. Yet they had worked in Sardinian emergency rooms, including the San Francesco hospital in Nuoro.

That story ended in four videos, with thousands of views, published on social media by former MP Mara Lapia, who had been sued for defamation. The unfit doctors had asked the court to remove the content from the web because it damaged their image. But for Judge Denise Ecca, " the right to criticize was being exercised, on a matter of public interest related to the protection of health and the management of public funds. The videos contained truthful statements supported by documentation."

These arguments were also presented yesterday in court before the preliminary hearing judge of the Nuoro Court, Mauro Pusceddu, by lawyers Pietro and Mario Silvestro Pittalis, representing Lapia, during the hearing opposing the motion to dismiss the case for defamation. At the conclusion of the hearing, the judge reserved his decision.

In support of their position, Lapia's defense cited the order of the Civil Court of Nuoro, which rejected the request of Fernando René Benitez, German Gustavo Galvez, and Agostina Cogliano to have the four videos posted on Facebook and Instagram removed.

The Court recognized the public relevance of the matter, also noting that the negative assessments expressed by the technical commission were documented.
