The Constitutional Court has rejected the appointment of a special administration to administer Sardinia's health authorities.
The Constitutional Court, in a ruling filed today, deemed Article 14, paragraph 1, of Regional Law No. 8/2025, approved in March—which had dismissed the managers—unlawful because it does not modify the general structure of the regional healthcare system and therefore does not meet the requirements of constitutional jurisprudence for the institution of commissionership. A reform would have been necessary to justify it.
In particular, the Constitutional Court affirmed that the regional law left intact the institutional organizational structure of the island's healthcare system.
The risk now is that problems may arise regarding the tenure of the current commissioners and the impossibility for the Region to appoint new general directors, as announced by President Alessandra Todde.
From a compensation perspective , the general directors declared lapsed in September could advance claims for damages against the Region.
The Court also struck down Article 6 of the law, which established the criteria for creating lists of aspiring health and administrative directors of the Local Health Authorities and allowed for their replacement: the entire law was unlawful.
The Region
The Region's reaction came with an impersonal note: "The Regional offices are already working to analyze the Court's ruling, and in the coming hours, they will carefully evaluate all related aspects and the actions to be taken. Our path to revitalizing Sardinian healthcare, in the sole interest of Sardinian citizens and the right to healthcare, is in no way under discussion," according to sources close to the presidency.
