The Constitutional Court deemed the Sardinian law illegitimate which, by reproducing the content of another already declared unconstitutional, reintroduces the right to rebuild a demolished building on the coastal strip without preserving its shape and location.

The rejection came on an article, 130, of law 9 of 2023, the so-called Connected to the Financial Act, in the part in which it reintroduced the possibility of demolishing and reconstructing the buildings located in the 300 meter range from the marine shoreline even without preserve its conformation, location and original planimetric, volumetric and typological characteristics.

The regional provision, essentially reproducing a similar provision declared unconstitutional by the ruling of the Consulta number 24 of 2022, carries out the violation of a specific constitutional ruling in contrast with article 136 of the Constitution.
