The Tempio prosecutor Gregorio Capasso has requested 9 years in prison – with mitigating circumstances – for Ciro Grillo , Vittorio Lauria, Francesco Corsiglia and Edoardo Capitta , accused of the alleged gang rape that allegedly occurred in the summer of 2019 in Porto Cervo.
In his closing statement, Capasso insisted on the lack of consent of the alleged victim of the sexual violence alleged against the four young men. The prosecutor said: "The girl was intimidated, she was afraid."
In court, where the defendants did not appear today, Capasso also spoke about the obscene photos which he said portray the raped girl's friend while she was sleeping , with two of the young men who allegedly brought their penises close to the girl's face.
"Everyone - concluded Capasso - was involved in a story bigger than them . Everyone cried, six very young boys were involved. I therefore ask with mitigating circumstances a sentence of 9 years of imprisonment".
After the requests of the prosecutor Capasso, the word was passed to the lawyer Vinicio Nardo , the lawyer of the girl who was photographed while she was sleeping , and who, according to the prosecutor, had his penis placed against her forehead.
Lawyer Vinicio Nardo spoke of an "exercise of power over the object of domination, a woman" .
Nardo – who suggested everyone to read Truman Capote’s book, “In Cold Blood”, to have a description of victims and executioners – described the group dynamics, also speaking of an “attack on the victim’s free determination” . The lawyer then described the conduct contested to Grillo, Lauria and Capitta, defining it in all respects as “sexual violence” .
Lawyer Fiammetta Di Stefano is also assisting the girl who was allegedly photographed while sleeping: «Every time my client meets a boy she wonders if he is capable of conduct like the one she suffered» , she said, asking for the defendants to be convicted and for 50 thousand euros in compensation for her client .
At the hearing, the lawyer Giulia Bongiorno, who is representing the alleged rape victim, then took the floor . Bongiorno pointed the finger at the chats: «The girls in the chats are systematically called “sluts”. The chats reveal what the concept of women's freedom is. It doesn't matter what the “slut” on duty wants», Bongiorno underlined ( READ ).
In closing, in the afternoon, Dario Romano, the lawyer of the alleged victim together with Bongiorno, spoke. He asked for the conviction of the four boys, then a provisional sum of at least 100,000 euros in total plus legal costs, the amount of which was not indicated . Nardo, in his speech, insisted a lot on the fact that the girl victim of the alleged rape was considered, after a series of rather severe tests, a reliable person with no pathologies who «for what she has suffered and is suffering, cannot have made it all up».
