The arrest warrant that led to the arrest of brothers Gianmarco and Filippo Tunis , aged 24 and 20, respectively, from Cagliari, has been annulled or amended. They were arrested along with Daniele Campus , 22, on charges of aggravated voluntary manslaughter and robbery in the death of 23-year-old Leonardo Mocci. Mocci was killed by a gunshot to the chest in Monserrato on the night of April 23.
Attorney Riccardo Floris, representing the two brothers, filed the motion with the Review Court today . Floris believes that "the order is contradictory and therefore manifestly illogical," he told ANSA. "I believe that the review by the Review Court is mandatory in a circumstantial trial like this."
According to the lawyer, there are "inconsistencies" in the various testimonies collected by investigators . The judges of the Court of Appeal will also have to decide on the request to overturn the order to seize the phones, filed by lawyers Alberto Pani and Francesca Mannai, representing the other arrested man.
According to the prosecution, the three, along with a fourth person, allegedly set a trap for the victim and a friend who had gone to Monserrato on the evening of March 23rd to buy a batch of drugs. The four allegedly attacked the victim's friend and attempted to rob him. Leonardo Mocci allegedly got out of the car to defend him and was shot in the chest.
