The deadline for filing appeals against the Grillo sentence has expired, and today it is possible to summarize the decisions of the parties ahead of the second-instance trial. Tempio's prosecutor, Gregorio Capasso , has not appealed the convictions, while the civil party's lawyer, Giulia Bongiorno, has done the same . Therefore, there will be no second-instance sentences with increased sentences. The defense attorneys for the four defendants, however, have appealed the Tempio Court's verdict. Lawyers Enrico Grillo, Andrea Vernazza, Alessandro Vaccaro, Ernesto Monteverde, and Mariano Mameli have appealed for the son of Five Star Movement founder Ciro Grillo; lawyers Edoardo Capitta and Vittorio Lauria; and criminal lawyer Antonella Cuccureddu has appealed for Francesco Corsiglia. Corsiglia was sentenced to six years and six months in prison, while the other men (all from Genoa and born in 2000) were sentenced to eight years. Prosecutor Gregorio Capasso had requested a nine-year prison sentence for the four young men accused of gang rape against a female peer, incidents that occurred in Porto Cervo in the summer of 2019.

The defense claims that the judges failed to consider the defendants' arguments and is requesting that the ruling be overturned. It is also reported that one of the judges who drafted the ruling failed to sign it, a ground for nullity according to the defense.

According to the appeal documents, Francesco Corsiglia's position is now clearly separate from that of the other men. The young man was acquitted of raping the victim along with Ciro Grillo, Vittorio Lauria, and Edoardo Capitta (the third incident of violence listed in the indictment). He was instead convicted of raping her alone, according to the prosecutor, while three other friends prevented the girl from escaping. The appeal arguments are clearly distinct from those of the other defendants. Criminal lawyer Antonella Cuccureddu highlighted alleged serious inconsistencies in the timing of the alleged events in Corsiglia's case, on one page of the grounds, stating 9:30 a.m. and on another, stating between 6:25 a.m. and 7:15 a.m. on July 17, 2019.

The criminal lawyer highlighted the aggressive and taunting attitude of Ciro Grillo and the other two boys towards Corsiglia, while the young man was having what the defense considers consensual sexual intercourse with the alleged victim.
