Flavio Briatore and the extra luxury villas in Pevero: the Council of State says no

The Council of State has rejected the appeal of the entrepreneur Flavio Briatore, the company Sardegna Due srl will not be able to build two extra luxury villas in the agreed development “GOLF-1” of Pevero, in Porto Cervo .
The magistrates of last instance of the administrative justice have given reason to the Municipality of Arzachena that in 2021 had frozen the concession process of the villas. Sardegna Due Srl was established, together with other real estate companies, for interventions in the Gulf of Pevero, on a regularly approved subdivision (“Golf 1” agreed in 1975).
But in 2021, the administration led by Mayor Roberto Ragnedda, and represented in court by the lawyer Stefano Forgiarini, denies the volumes because the Municipality of Arzachena, not having the Puc, cannot calculate the "approved" cubic meters.
For Briatore's company it is also a mockery, because others have obtained the permits that the entrepreneur is being denied. The Council of State has established that the Municipality of Arzachena "has not violated the transitional discipline, for having postponed the calculation of the volumes of the tourist settlements admissible in the F zones until the adoption of the new Municipal Urban Plan".
