A 35-year-old case is now coming to a close. It concerns the nearly €800,000 in damages owed by the Municipality of Cagliari to two citizens for the expropriation of the Asse Mediano junction in Genneruxi. The Court of Appeal ruled in 2024, with the full amount due soon.
The dispute began as early as July 20, 1990, when, with Mayoral Decree No. 83, the Municipality of Cagliari initiated expropriation proceedings, with the emergency occupation of the area for the construction of the Genneruxi-Viale Marconi interchange on the Asse Mediano , then under construction. Two private individuals, with a writ of summons dated September 14, 1995, filed a claim for compensation: they had lost ownership of the area, which had been irreversibly transformed.
The Court of Appeal, with ruling 464/2024 of December 6, ordered the Municipality to pay the appellants a total of €716,415.85 in compensation for the "loss of ownership rights and for the period of unlawful occupation of the property, plus statutory interest from the date of the final ruling."
The recent City Council resolution, dated July 15, acknowledged the €800,000 off-balance sheet debt. The sum, including legal fees and interest, will be paid to both parties shortly, net of €35,258.35 already paid .
