The four-year prison sentence for sexual assault handed down to Fabrizio Aru, 34, from Ussana, former organizer of the “Soho Discoclub” on Via Newton, has become definitive.
The Supreme Court of Cassation upheld the Cagliari Court of Appeal's verdict, rejecting the appeal filed by the defendant's lawyers, Leonardo Filippi and Roberto Sorinelli. Aru now risks prison time, but his lawyers have already filed a motion for an alternative sentence , based on his ongoing rehabilitation.
Fabrizio Aru has always maintained his innocence in the case, reiterating that he never raped the girl. The 24-year-old, represented by lawyer Carlo Amat, had accused him of holding her in the locker room reserved for the club's staff, forcing her to perform sexual acts against her will.
According to the prosecution's reconstruction, the events occurred on November 28, 2021, at the nightclub. After the investigation was concluded, the Prosecutor's Office requested the organizer be sent to trial, who then opted for a summary trial. From the outset, Aru, well-known in the city's nightclub scene, vigorously defended himself, denying any sexual abuse, even allowing himself to be questioned after the evidentiary hearing. The Court judge, however, deemed the charges proven and—accepting the requests of prosecutor Ginevra Grilletti—sentenced him to 5 years and 4 months and awarded the woman a provisional sum of €25,000. After the appeal was filed by attorney Sorcinelli, the Court presided over by Judge Massimo Poddighe upheld the conviction but reduced the final sentence to 4 years in prison. The sentence has now been finalized by the Court of Cassation.
