Cagliari professor sentenced for defamation against colleague from Sassari University

Sentenced to a 2800 euro fine, yesterday in court in Sassari, the former university professor of Cagliari Giampaolo Loy, known as Gianni, accused of defamation. Loy had denounced in two emails, sent between 2019 and 2020 to various professors of the Sassari university, some alleged irregularities relating to the 2012 "Rientro Cervelli" competition, announced by the Turritana university to find fixed-term researchers. And he accused, among others, Professor Giovanni Maria Uda, member of the Review Commission on the competition procedure, of having made omissions in the control of the applications for participation.
Phrases considered defamatory and which referred to investigations by the Guardia di Finanza for a proceeding against the members of the commission which, as recalled in the indictment, had however already been archived by the investigating judge in 2018 .
The defendant, defended by the lawyer Giambattista Gallus, had the opportunity to present his reasons in the Courtroom, during the spontaneous declarations, reading a memorandum that retraced the entire affair and in which he reiterated the existence, in his opinion, of irregularities. However, specifying in the writing, in relation to Professor Uda: «I have never stated that the omission was intentional and deliberate and it is not my responsibility. Moreover, I reiterate that, for my part, I have always referred to irregularities and never to criminal liability. The irregularity of an administrative procedure is not synonymous with relevant conduct».
Judge Anna Pintore also decided that the damages to the injured party, who joined the civil action with the lawyer Pierluigi Carta, be compensated in a separate trial, ordering that a provisional sum of 7 thousand euros be paid. The lawyer Gallus has announced that he will appeal.
