In the space of three weeks, the doctor Tomaso Cocco, head of the pain therapy center of the Binaghi hospital in Cagliari, had gone to five banks in the capital and in Selargius to use the ATMs, had entered the Conad di via Argentina and Is Mirrionis and twice to Mediaworld in Sestu, he had gone to a pharmacy and, using a taxi, to a dental office. Movements that took place between 23 October and 10 November 2020, a period during which the white coat was obliged to stay in home isolation because he tested positive for Covid-19 after being subjected to the swab on 19 October. Instead, according to what was reconstructed by the Nas, he had left the house coming into contact with other people and infecting one.

This is why the prosecutor Rossana Allieri, already closed the preliminary investigations, has now requested the indictment of Cocco on charges of malicious epidemic and violation of anti-virus rules. The 52-year-old accused, who appealed to lawyer Rosaria Manconi in defense, will appear before the judge of the preliminary hearings Roberto Cau on 22 March. With him there will be the 50-year-old Vittorio Lai of Vallermosa, who is only responsible for the second crime and is assisted by the lawyers Giorgio Manurritta and Gianfranco Sollai: positive result on 31 October 2020, he was not left in isolation but between 2 and 13 November of that 'year he had been in a pharmacy, a distributor and a market in Vallermosa, then in a trattoria in Iglesias and at an acquaintance, finally he had picked up twice at an ATM.

Cocco, according to the investigating magistrate (who also informed the hospital and the Ministry), even knowing he was positive, had come into contact with "a plurality of subjects" and had "transmitted the virus" to Lai, who was infected "a few days later" . It was the carabinieri, checking compliance with the regulations in the health centers, who noted the closure of two wards at Binaghi (one was that of Cocco) and discovered that the doctor was leaving the house despite the restrictions. Hypothesis then confirmed, according to them, by other verifications. Including those concerning the cells hooked up by his cell phone in those days.
