Acquitted on all counts contested.

The first criminal section of the Court of Appeal of Cagliari , presided over by Gemma Cucca, partially reversed the sentence issued in the first instance against Enrico Loria, the psychiatrist of the Cagliari local health authority - defended by the lawyers Carlo Murtas and Michele Capano - who ended up on trial for abandonment of incapable persons, omission of official acts and fraud .

The court had sentenced Loria to 3 years and two months for the first two offences, but had acquitted him of the fraud for only a fraction of the time with the formula "the fact does not exist", which the appeal judges have now changed to "in particular tenuousness of the fact".

At the time of the first instance trial, in 2021, the prosecution had accused the psychiatrist of having voluntarily neglected his patients at the mental health center of the ASL , replacing therapies with collective prayer sessions.
