The election of MEPs from the Italian Insular constituency to the European Parliament is legitimate.

Luigi Marcialis, a voter from the Municipality of Cagliari, did not consider it such, having filed an appeal with the Council of State, arguing for the need for a rebalancing to ensure greater representation of Sardinians in the European Parliament.

The appeal judges, however, rejected the appeal, which challenged the outcome of the elections of June 8 and 9, 2024, which saw Giuseppe Antoci, Raffaele Stancanelli, Giuseppe Lupo, Leoluca Orlando, Ruggero Benedetto Italo Razza, and Giuseppe Milazzo elected to Brussels.

Of the 76 seats allocated to Italy in the European Parliament, the law assigns eight to constituency V - "Insular Italy," which includes the regions of Sicily and Sardinia . Given the different demographic weights of the two islands (Sicily has more than three times the population of Sardinia) and the current electoral system (proportional representation with a national threshold of 4 percent of valid votes cast), according to Marcialis, this would have the effect of ensuring representation in the European Parliamentary Assembly only for Sicily , as only candidates from that island's territory would be elected. For this reason, the question of constitutional legitimacy has also been raised.

The lawyers for the deputies Antonino Gerbino, Emanuele Passanisi, Giovanni Immordino, Giuseppe Immordino, Fulvio Ingaglio La Vecchia, and Massimiliano Mangano contested the appeal's assertions, arguing that the voter acted not in the general interest of ensuring the proper conduct of the elections, but rather to obtain a judicial ruling limited to the polling stations indicated in the appeal, without challenging the correctness of the election's conduct . The administrative judges therefore found the appeal unfounded.
