This is a formal warning presented by Piero Maieli, a Forza Italia councilor and member of the Election Committee. The recipient is Giuseppe Frau (Uniti per Todde), president of the body .
This act reignites the political conflict over the disqualification case, which the Forza Italia councilor reconstructs as follows, recalling all the steps: the Elections Committee's order highlighting the "serious violations" in the election expenses report, decreeing the governor's disqualification; and the February 4th meeting of the same Committee, which had decided to await the outcome of the appeal filed by Todde's lawyers in the civil court . "Despite the fact that the dispute was solely about the imposition of financial penalties and its outcome was therefore completely irrelevant to the disqualification declaration," Maieli emphasizes.
Now that the Court has rejected the governor's appeal, "confirming the validity of the complaints," the time has come to reconvene the Council and decide on the dismissal . Moreover, the Forza Italia member continues, the Court "clearly states that the verification of violations is the exclusive responsibility of the supervisory bodies, and that the Regional Council must simply acknowledge them and decide on the dismissal ."
In support of his request, Maieli also cites a 2020 opinion from the Ministry of the Interior , according to which, in the event of confirmed violations of the rules on electoral expenses, the Council has no discretion. It must simply acknowledge the disqualification , without voting or evaluating the merits.
Maieli also reserves the right to appeal to the TAR or to request the intervention of state bodies , to prevent "failure to adopt the required measures to give rise to possible accounting and criminal liabilities, or to the application of the sanctions provided for by Article 50 of the Special Statute for Sardinia", which regulates the exercise of substitute powers by the State in the event of non-compliance by regional bodies.
Other appeals against the Civil Court's decision are pending, including one before the Constitutional Court for a conflict of powers, the first hearing of which will be held in September. But according to the opposition representative, it's wrong to continue waiting; the governor's dismissal must be declared immediately, "a necessary act," according to the Civil Court judges.
For her part, Alessandra Todde , asked about the new clash on the sidelines of an event on the Einstein Telescope, preferred to gloss over the topic.
"I was elected to carry out an electoral program, and as long as I'm allowed to, I will carry out my electoral program," she said. She cited the Region's "effort" to "reclaim the Sant'Ignazio hill, which had been reclaimed from energy speculation," and spoke of the Einstein Telescope.
Regarding the forfeiture of office and the formal notice filed by Maieli, nothing: "I believe that Sardinians right now don't want to hear about elections and simply want answers to their problems and a hope for change and a future . I want to talk about that. I was elected for this, and for as long as I can, I will work every second toward this goal and with this objective."
