Yes to the conviction for injury and compensation for a father and daughter who, while playing beach tennis on the shore, inadvertently sent a ball flying into the eye of a swimmer, causing a retinal detachment in his left eye.

The Court of Cassation has ruled: the incident, which occurred on a beach in Salento, dates back to 2015.

A father and his two daughters were playing on the beach when the ball went off course, violently hitting a person at eye level.

The case ended up in court, with the Justice of the Peace and then the Court of Lecce finding the two defendants liable, imposing a fine of €516 each and a provisional sum of €10,000 for the injured party.

The father and daughter appealed with a lawyer to the Supreme Court of Cassation: the defense argued that there was no evidence to prove permanent damage or a direct link between the blow and the injuries sustained, especially since the swimmer would not have gone to the emergency room until a few days later.

The Supreme Court, however, declared the appeal inadmissible. For the judges, the surgical procedure the victim underwent and the subsequent clinical picture confirmed the severity of the injury and its connection to the accident on the beach .

In addition to the fine and the provisional penalty, there will now be a fine of three thousand euros each to be paid to the Fines Fund and the payment of legal costs.
