At the third appeal trial for the massacre at the Viareggio station (Lucca) on 29 June 2009, the 5-year sentence was confirmed for the former CEO of FS and RFI Mauro Moretti , one of the 12 defendants for whom the second-instance judges of Florence, after the referral by the Supreme Court, were called upon to quantify the sentences limited to the amount of the reduction in sentence imposed for mitigating circumstances.

The trial concerns the responsibilities for the accident of 29 June 2009, when the explosion of an LPG tanker at the station in the Tuscan city caused 32 deaths and dozens of injuries.

Not only Moretti but all the other 11 defendants had their sentences confirmed in the previous appeal trial and then annulled by the Supreme Court, which had once again sent the proceedings back to the second-instance judges.

Among the 12 defendants is also the former CEO of RFI Michele Mario Elia who received 4 years, 2 months and 20 days .

The other sentences are: Mario Paolo Pizzadini , manager of Cima Riparazioni, 2 years, 10 months and 20 days; Daniele Gobbi Frattini , technical manager of Cima Riparazioni, 2 years, 10 months and 20 days; Mario Castaldo , former director of the Cargo Chemical division, 4 years; Uwe Kriebel , worker at the Junghental workshop (Germany), 4 years, 5 months and 10 days; Helmut Broedel , executive officer of the Junghental workshop in Hannover, 4 years, 5 months and 10 days; Andreas Schroeter , technician at Junghental, 4 years and 8 months; Peter Linowski , managing director of Gatx Rail Germany, 6 years; Rainer Kogelheide , managing director of Gatx Rail Austria, 6 years; Roman Meyer , manager of the wagon fleet at Gatx Austria, 5 years, 6 months and 20 days; Johannes Mansbart , manager of Gatx Rail Austria, 5 years and 4 months.

"We are disappointed and will appeal to the Supreme Court," said Moretti's lawyer Ambra Iovine after the ruling. Moretti was present in the courtroom and left the courthouse in silence.
