The "short touch" does not constitute a crime. This was established by the judges of the fifth criminal section of the Court of Rome, who acquitted the janitor of a Capitoline school who went to trial on charges of sexual assault for touching a student in April 2022.

According to the magistrates, the "felt", which lasted "between 5 and 10 seconds", according to what was reported by the victim, took place. But it was very brief and there was no willingness on the part of the janitor to molest the minor.

The judges therefore did not accept the prosecutor's approach, which asked for a sentence of 3 and a half years. The school employee admitted that he had touched the girl but that he had "done it as a joke".

The janitor's action, the judges write, "lasts a handful of seconds, without any delay in touching". A maneuver, in essence, "clumsy but devoid of lust".
