According to initial findings by the Carabinieri , Vincenzo Crudo, the man who on the night of March 29th hit and killed—without providing assistance—Noemi Fiordilino, the 20-year-old woman who had gotten out of her car with her boyfriend to help a rabbit in Lurago Marinone, in the Como area, had a blood alcohol level of 1.46.
The family's lawyer, Edoardo Mastice, however, intends to fight back: " We're waiting for the prosecutor to supplement the investigation with the findings of our experts," he explained to Corriere della Sera. " For example, we've demonstrated that the blood alcohol level at 2 a.m., at the time of impact, was 1.80. With such a high reading, the sentence ranges from 8 to 12 years."
A significant difference for legal purposes: "With a rate below 1.50, a lower sentence, and the fast-track trial , the suspect could receive a sentence of less than four years and apply for community service. If, however, the rate is found to be higher than 1.50, he won't receive a sentence below seven years. And consequently, he would be imprisoned."
The man (who was driving with an expired license, a leg in a cast, and was intoxicated) said when the officers arrived at his home that his car had been stolen. It was found in a field. He was arrested and after three months confessed, obtaining house arrest. He is now awaiting trial.
