Overturning the first-instance ruling, the Bologna Court of Appeal ruled that a woman, the mother of two minor children and the widow of a man who died from Covid-19 in March 2020, must repay €200,000 to the insurance company—with which she had taken out a standard life insurance policy that covers accidents—which had been ordered to pay the premium.

The Corriere di Bologna reports. The man worked at a car dealership. The Parma court upheld the arguments of the family's lawyer, Francesca Barbuti, and ordered the payment.

But the judges of the Court of Appeal overturned the verdict, also ordering the widow to pay the legal costs, approximately 24,000 euros.

According to the judges, "it is clear that in the case of Covid-19, it is not the cause that is violent, but rather the effect. Therefore, if the viral infection, despite having a violent effect, is not the consequence of a violent cause, then Covid-19 infection cannot be included within the definition of accident, as referred to in the insurance policy ."

Now the woman will evaluate whether to appeal to the Supreme Court.
