The notice of closure of the investigations was served on the three municipal councilors of Cogoleto, in the province of Genoa, accused of having violated the Mancino law.

According to the prosecutor and the police, the three, who after the controversy had claimed to have raised their hands for a vote, had made the Roman salute during the session of the city council on 27 January 2021, the day of Remembrance. These are the exponents of the center-right Francesco Biamonti (Lega), Mauro Siri (independent) and Valeria Amadei (Brothers of Italy).

The police had also arrived in the Municipality, after the mayor Paolo Bruzzone had expressed disdain for the incident on Facebook, and the policemen had acquired videos and minutes of the assembly and listened to Bruzzone and the operator who had carried out the shooting, first to notice the gesture. The case had also arrived in the prefecture, with the initiation of an investigation procedure solicited by the opposition in the regional council (Lista Sansa, Pd, Movimento 5 Stelle and Linea shared).

Mayor Bruzzone then sent a written report on the episode to the prefect, then Carmen Perrotta, asking to declare the forfeiture of all three councilors. No decision was made on the matter, but in the meantime Siri and Biamonti resigned, the latter after writing a post on Facebook disrespectful of Gino Strada on the day of the disappearance of the Emergency doctor. Siri also claimed that in the specific case he had held his arm that way due to difficulty in bending it.

The mayor announced that "the Municipality of Cogoleto is ready to form a civil party".
