The accusation for Lovato is very serious, intentional homicide . «On the basis of the findings of the medical-legal consultancy – the Latina Prosecutor's Office says – the hypothesis initially configured (manslaughter) has changed and the crime of intentional homicide with possible malice is contested». The examination in fact ascertained that if the man, "who died due to copious loss of blood, had been promptly helped, he would in all likelihood have been saved" .

In the note, the Prosecutor's Office of Latina adds that "the worker's conditions after the accident were so serious as to make the need for prompt assistance clear". Therefore, " the decision to omit the necessary assistance constituted acceptance of the risk of the lethal event and integrated the cause that directly determined the death".

«Regardless of ethical evaluations (irrelevant for criminal law) which would also be required in the face of inhuman conduct and detrimental to the most basic values of solidarity, it cannot be overlooked that the suspect was intentionally and voluntarily disinterested in the probable consequences of his actions », writes the investigating judge of Latina, Giuseppe Molfese, in the precautionary order.

The judge reconstructs what happened on June 17 in Cisterna di Latina: " Lovato, contrary to what was due, loaded the body into the van and the amputated limb separately and abandoned the body and the limb in Via Genova, and fled ."

For the Latina court, the circumstance according to which the suspect did not want the death of his Indian laborer, but «for the conduct implemented and the lucid operating methods (disavowed only by his declarations, according to which would have acted in the terms described because he was in shock) reasonably predicted the probable death of Satnam, knowingly accepting the risk ".

The conditions of the laborer "make, for anyone's assessment, the fatal event inevitable, especially in the absence of a sudden medical intervention". The behaviors following the abandonment of the body "uniquely argue and characterize the homicidal conduct - writes the investigating judge -, precisely in descriptive terms of the possible intent".

The suspect failed to call for help, " he escapes with the van, proceeds to clean up the blood : the main aim of the suspect was clearly to conceal the incident, on the other hand, one of his workers, illegal on the national territory, without a contract, without anti-accident protections and using non-certified work equipment, he had amputated an arm , was losing profusely blood and had suffered other serious injuries".

The investigation, the investigators specify, continues both with reference to the crime under dispute and to other crimes committed, "with specific regard to the assessment of working conditions".
