Carlo Nordio's judgment is clear-cut : the decision of the Rome Tribunal on migrants in Albania is " abnormal ". And it is accompanied by a warning: " If the judiciary exceeds its powers by attributing to itself prerogatives that it cannot have , such as that of defining a safe State, politics that expresses the popular will must intervene ".
The Minister of Justice assures that the government has not declared war on the judiciary but, given the heated tone of the last few hours against "politicized judges", the opposition has an easy time claiming the opposite . And they are also attacking Giorgia Meloni's next move: a decree law to be approved on Monday in the Council of Ministers to make the indication of safe countries a primary rule, and no longer secondary, as is instead the decree of the Minister of Foreign Affairs in agreement with those of the Interior and Justice, with which the list has been updated annually up to now.
The issue of migrants was also at the center of a video of the Pope to Catholic Action , in which he supported the need to "give them food, give them a hand so that they don't sink. We cannot close the door to migrants." And it will end up at the top of the questions at the Prime Minister's press conference on Tuesday, initially designed to present the maneuver and scheduled for the second anniversary of her government. Two years in which there has been no shortage of clashes with that part of the judiciary that, they are convinced at Palazzo Chigi, is trying to oppose by going beyond its own prerogatives.
"Freeing" justice from the "yoke of currents" is one of the objectives of the center-right, through the separation of the careers of magistrates , now under examination by the Constitutional Affairs Committee of the Chamber. So much so that criticism has been directed, from various parts of the majority, at Silvia Albano, one of the judges of the immigration section of the Court of Rome and president of Democratic Magistracy.
Already in May, when the list of safe countries was updated, Albano stressed that the ministerial decree was a secondary source of legislation, subordinate to the Constitution, ordinary laws and EU legislation, and that therefore judges are responsible for verifying whether the safe country "can actually be considered as such based on what is established by law". This is exactly what was done - also in light of a recent ruling by the EU Court of Justice - for the cases of the 12 asylum seekers taken to Albania on Wednesday, and then in the early afternoon moved by patrol boat to Bari . For the president of the ANM Giuseppe Santalucia it is «only the application of binding rules not only for magistrates but for States. They will also be binding for the government when - as has been announced - it prepares to find new solutions». According to Meloni this "prejudicial" approach prevents a "policy of border defense". "We will not retreat", is the line in her party. The government's response will be a decree law, which concerns not only the indication of safe countries but probably also a review of the examination of asylum applications and the mechanisms of appeals. A solution, government circles reason, to ensure that the centers (not only the one in Albania) for the repatriation of irregular immigrants who are not granted asylum still make sense.
Given what is happening, even after Nordio's words, the evolution of the situation is being followed carefully at the Quirinale , where however for now the utmost secrecy reigns.
The Albania operation, they assure in the executive, will continue regularly. The timing of the next landing at the port of Shengjin of an Italian military ship with migrants on board, it is emphasized, will also depend on the sea conditions. In the meantime, the CPR of Gjader has immediately emptied. And the opposition goes on the attack. Italia Viva announces "a formal complaint to the Court of Auditors" for waste of public money, and the M5S will do the same with Alfonso Colucci, according to whom the transport of the first 16 foreigners to Albania cost "about 18,000 euros per migrant". Pd, M5S and Avs call for Nordio's resignation, Riccardo Magi of +Europa accuses him of "serious interference that violates the constitution". For the Democratic leader Elly Schlein a "very serious institutional clash" is underway. And from her party Debora Serracchiani predicts that the legislative decree in preparation will be "a stretch". Yesterday evening, interviewed on Tg1, Matteo Salvini then attacked, referring to the migrants in the Albanian case : "If one of them were to commit a crime tomorrow, a rape, would the magistrate who brought him back to Italy pay?", he said, calling the League to mobilize against "politicized judges".
