Alessia Pifferi will undergo a new psychiatric evaluation . The Court of Assizes of Appeal of Milan has decided, accepting the request made by the defense attorney Alessia Pontenani.

The 38-year-old, sentenced in the first instance to life imprisonment for the murder of her daughter Diana, the 18-month-old baby who died of starvation after being left alone at home for six days , had already undergone an examination which deemed her capable of understanding and willing.

The defense, on the contrary, has always maintained that he suffered from a "serious cognitive deficit" . The deputy attorney general Lucilla Tontodonati had instead maintained that there was no need to carry out a new expert assessment.

"Alessia Pifferi never lied, she lied as a person with little ability can lie. She told lies that had short legs, just like children do. She did not have a great ability to lie or simulate, she did not even know what the term simulation meant, she asked me at the end of the first degree trial. Pifferi has serious cognitive problems ", the defense attorney had said before the Court of Appeal.

From the first assessment, carried out by the expert Elvezio Pirfo, she was found to be capable of understanding and willing .

Civil party lawyer Emanuele De Mitri, who represents sister Viviana Pifferi and mother Maria Assandri, had joined the prosecution's request not to carry out a new expert examination. "The sentence certified that Pifferi was a lying, simulating woman who invented circumstances in order to save her position. Even during the expert examination she simulated a person she never was and she also lied in front of the expert ."
