Florence Court investigating judge Patrizia Martucci has dismissed the charges against Marcello Dell'Utri, who is under investigation as part of the investigation into the alleged hidden instigators of the 1993 Mafia massacres.

According to the judge, "there is a lack of concrete evidence of direct contacts/relationships between Cosa Nostra and Silvio Berlusconi, and therefore Marcello Dell'Utri, Berlusconi's close associate." For this reason, on January 15th, he signed the dismissal order. After thirty years of investigations, this is the sixth dismissal.

The Florentine DDA's investigation into the 1993 mafia massacres in Florence, Milan, and Rome implicated Silvio Berlusconi and, now, Marcello Dell'Utri. Investigators' hypothesis was that the massacre campaign was intended to further the political success of Forza Italia and the rise of Berlusconi. Dell'Utri, in particular, was under investigation for instigating and soliciting mafia boss Giuseppe Graviano to organize the massacre campaign.

According to the prosecution, he served as an "indicator of locations" for the attacks, with the aim of creating a climate of terror useful to the new political project. The defense of Dell'Utri, whose Milan home was searched in July 2023, has always called these hypotheses "fanciful," questioning the credibility of the collaborators and emphasizing the lack of corroboration, now confirmed by the judge who ordered the dismissal of the case.
