The Ministry of Justice will carry out all checks and, if necessary, will take appropriate initiatives. This is written in the response signed by Carlo Nordio, to the question presented over a month ago by Pietro Pittalis (Forza Italia) and other deputies of FdI and Lega on the case of forfeiture.
The MPs had requested the minister's urgent intervention against the acting president of the Court of Appeal of Cagliari, Massimo Poddighe, the new number one of the Electoral Guarantee Board who, under the presidency of Gemma Cucca, had notified at the beginning of January the injunction order that risks removing the president of the Region and, in cascade, determining the dissolution of the Regional Council. The MPs (Pittalis, Mura, Giagoni, Calderone, Costa, Bellomo, Deidda, Lampis and Polo) had denounced "serious irregularities and strong concerns".
In particular, the presence of a conflict of interest that "undermines the autonomy and independence of the judiciary: Judge Poddighe is the husband of Marcella Marchioni, appointed by the Todde Council first to the Directorate of Financial Services, then in March as Secretary General of the Region (while waiting for Eugenio Annicchiarico to take up office).
The fact that they are married would represent a conflict of interest that "undermines the autonomy and independence of the judiciary". Hence the request to Minister Nordio to intervene "also through the activation of his own inspection powers, in order to ascertain any disciplinary responsibilities on the part of the acting President".
And Nordio writes: «The feared suspicion cannot exempt this Administration from carrying out all the necessary checks. For this reason the competent ministerial branch has been given the task of proceeding in this direction».
