The case lapses again in the Chamber with the majority motion that commits the Council to raise the conflict of attributions with the State on which the Constitutional Court is called to judge.

The discussion has just begun. Up to now, the majority has refined the text, with the aim of making it palatable to the opposition, which in recent days has harshly criticized some passages. For example, the reference to the need to restore the "violated legality" by the Electoral Guarantee Board which - this is the reason why the Consulta is being used - would not have the authority to impose or request the removal of the President of the Region Alessandra Todde, which would be followed by the automatic dissolution of the Regional Council. But the opposition does not seem willing to accept mediation.

For Paolo Truzzu of FdI, the motion, even without the references to the violated legality, «remains inadmissible».

The leader of the Democratic Party Roberto Deriu illustrated the motion. "We have to resolve an important legal point," he explained, "there is a fundamental problem: is it right that in our legal system there is legislation that allows the State, through an administrative body, to question the result of the popular vote?". Certainly, "there is the problem of understanding whether our legal system can allow that illicit behavior by a candidate can lead to the questioning and existence of a legislative body, the questioning and existence of an executive directly elected by the people, of a level of government that the Constitution equitably orders with respect to the State and other levels."

For Deriu «there is an attempt by an administrative body to enter the constitutional sphere of the Sardinian Regional Council. Which must now ask that light be shed on this case, and that justice be done with respect to the hierarchy of sources and the harmony of the system». For this reason «the Council is asked to propose the conflict of attributions. In this sense we have spoken of legality. Constitutional legality, that is, the constitutional order and the balance between the powers of the State».

First intervention, that of the deputy group leader of FdI Fausto Piga: «This is a motion ad personam, we could call it Salva Todde, and we are not willing to act as a crutch to the president after the mess she made. Because of the president, 59 councilors risk going home. But if she made a mess, then go home, we are not afraid to present ourselves again in front of the voters. The rules must be respected. Today I am not worried because the legislature is ending, I am because it has not started yet».
For the M5S, the group leader Michele Ciusa spoke: «This motion is not a political act, it is an act in defense of the Regional Council. We must protect the highest democratic expression of Sardinia, the Sardinian Assembly»
