«Announce the decree of the Regional Electoral Guarantee Board of 20 December 2024 for the part relating to the penalty of forfeiture and confirm the pecuniary penalty in the lower amount that the Court wishes to determine». This is what is requested in the conclusions filed today at the Court of Cagliari by the deputy prosecutor Guido Pani and the substitute prosecutor Diana Lecca , who represent the Prosecutor's Office in the civil proceedings that will have to decide on the appeal presented by the lawyers of the President of the Region, Alessandra Todde, against the injunction order of the Regional Electoral Guarantee Board that had sanctioned the governor with 40,000 euros and the transmission of the documents to the Regional Council to formalize her forfeiture following alleged violations in the statement of electoral expenses presented to the Regional elections.
The electoral proceedings that are taking place before the Civil Court, presided over by Judge Gaetano Savona (with colleagues Francesco De Giorgi and Bruno Malagodi), will have to decide on the appeal presented by the governor's lawyers (Benedetto and Stefano Ballero, Giuseppe Macciotta and Priamo Siotto). The hearing for the conclusions is set for May 22, but the documents should have arrived at the court by May 2. The one by professor-lawyer Riccardo Fercia, who defends the Electoral Guarantee Court and who has requested confirmation of the pecuniary sanction, has already been filed, while he has held that the Court cannot rule on the forfeiture because it has not yet been pronounced by the Regional Council. Eventually, it will be a matter for the Regional Administrative Court .
Today, however, the public prosecutor's office filed its conclusions, confirming that the declarations and the financial statement filed by President Todde "were not regular and presented some aspects of ambiguity, some deficiencies" and therefore a pecuniary sanction can be confirmed, but not in the amount decided by the Panel presided over by the former President of the Court of Appeal, Gemma Cucca .
