Professor-lawyer Riccardo Fercia has been revoked from both mandates to defend the Regional Electoral Guarantee Board at the Court of Appeal of Cagliari in the double proceedings - in the Tribunal and at the Constitutional Court - regarding the appeal against the injunction order on the reporting of electoral expenses of the President of the Region, Alessandra Todde.

The Court of Appeal body that evaluates the funding and expenses of candidates had sanctioned the Governor with 40 thousand euros and with the request for forfeiture sent to the Regional Council of Sardinia. Against this provision an appeal had been presented to the Civil Court of Cagliari by the lawyers of the president Todde, Benedetto and Stefano Ballero, Giuseppe Macciotta and Priamo Siotto. In relation to the injunction order , an application for conflict of attribution was also presented to the Constitutional Court by the Regional Council.

In both proceedings, both in the Tribunal and in the Consulta, the Board of Guarantee had indicated the internal defense, entrusted to Professor Fercia, member of the body, university professor of Roman Law and lawyer. When the president of the Court of Appeal, Gemma Cucca, retired in mid-April, she was replaced by the acting Massimo Poddighe.
A new meeting of the Electoral Guarantee Board had been called for this afternoon, in which the professor-lawyer was removed from both defense positions.

The university professor himself reports this. "Even though I had to abandon the patronage of the Guarantee Board," the press release states, "I proceeded to file , in the evening, in the trial pending before the Court of Cagliari, an act of autonomous adhesive intervention, aimed essentially at defending, in my interest, the provision that I had voted for." Therefore, Professor Fercia will still be present at the final hearing on May 22.

On this matter - linked to rumors about a change in strategy of the Electoral Guarantee Board after the departure of President Gemma Cucca - a request for intervention by the competent Ministries was announced in recent days by the vice president of the Justice Commission of the Chamber and regional coordinator of Forza Italia, Pietro Pittalis.
