With this motivation, the Cagliari investigating judge, Claudia Falchi Delitala, cancelled in less than 24 hours the precautionary measure against a 45-year-old resident of Selegas, who was forced to approach his ex-partner . The electronic bracelet he had been wearing was also removed after the woman filed a complaint with the Carabinieri of the Suelli station.
According to the investigating judge, who accepted the defense argument of lawyer Pierandrea Setzu and given the favorable opinion of the prosecutor, the man, during the preliminary hearing, " offered a different interpretation of the affair , tracing the disagreements with his former partner back to the banal and physiological disagreements of a couple regarding the management of the education and maintenance of their children ."
In practice, no acts of persecution were allegedly carried out by the 45-year-old . Furthermore, his ex-partner "has adopted ambiguous and ambivalent attitudes, demonstrating, for example, poor cooperation in the execution of the precautionary measure," the preliminary investigations judge's order states, stating that "both the evidence of guilt and the existence of precautionary measures appear to be significantly attenuated."
