The former mayor of Olbia Gianni Giovannelli was sentenced by the Court of Appeal of Sassari , which thus overturned the acquittal sentence pronounced in the first instance by the Court of Tempio Pausania for five of the six deaths of the flood that swept away on November 18, 2013 Olbia with the passage of the cyclone Cleopatra .

This morning the appellate judges sentenced Giovannelli , then mayor of the city of Gallura, to two years , the former head of civil protection Giuseppe Budroni to 1 year and 10 months and the municipal official Antonello Zanda to 1 year and 8 months. All had been acquitted in the first instance of the charges of multiple manslaughter and culpable disaster . Also acquitted this time the municipal manager Gabriella Palermo .

The court, chaired by Plina Azzena, went beyond the requests of the attorney general Gabriella Pintus, who had asked for a 1-year sentence for Giovannelli and Budroni and absolution for Palermo and Zanda.

The defendants were held responsible in various ways for the deaths of Francesco Mazzoccu , 37, and his son Enrico Mazzoccu , 4, Patrizia Corona , 42, and their daughter Morgana Giagoni , 2, and 83-year-old Anna Ragnedda . All acquitted instead for the death of Maria Massa, 88, because "the fact does not exist".

The defendants were granted the benefit of a suspended sentence .

The Court also condemned the 3 jointly and severally with the Municipality of Olbia, civil liable, to the payment of provisional payments in favor of the victims' families, from 40 to 100 thousand euros, for a total of 1 million 240 thousand euros, in addition to the legal costs of the parties civilians, a total of 139 thousand euros.

The second degree judges also ordered the transmission of the documents to the Sassari Public Prosecutor's Office, assuming the crime of perjury against two witnesses : the municipal official Giampiero Altamira and the volunteer Massimiliano Zippo . Instead, the documents to assess the criminal responsibility of the former councilor for civil protection of Olbia, Ivana Russo , and of the former commander of the municipal police, Gianni Serra , will be sent to the Tempio Pausania prosecutor's office.
