A few days after that of Daniela Poggiali, the former nurse acquitted in appeal ter from the accusation of killing the 78-year-old patient Rosa Calderoni, the acquittal also arrives for Giuseppe Re and Cinzia Castellani, primary and head nurse at the Lugo hospital where Poggiali worked.

The two, as established by the Court of Assizes of Ravenna, were acquitted in the hearing in which it was decided whether the trial should start or be postponed.

Both responded to voluntary murder with possible intent: according to the Ravenna Public Prosecutor's Office, despite the numerous alarm signals, they had not taken all the measures in their power to avert death.

The judges, on the other hand, acquitted them according to article 129 of the code of criminal procedure, which allows them to do so in every state and degree, when it is recognized that the fact does not exist or that the accused has not committed it or that the fact does not constitute crime or is not provided for by law as a crime and a condition of admissibility is lacking.

The acquittal took by surprise both the Public Prosecutor and the civil parties (the two sons of Calderoni and the Ausl Romagna), who had asked to hold the trial, and the defenses who had asked for a postponement to March, after the filing of the reasons for the appeal sentence. Now the Ravenna Court of Assizes will deposit the reasons for this sentence within thirty days.
