A new appeal process to recalculate and reduce the sentence imposed but "irrevocable criminal responsibility" recognition for all charges. This is what the judges of the Supreme Court ruled against the former mayor of Turin, Chiara Appendino, in the proceedings linked to the events in Piazza San Carlo on 3 June 2017 on the occasion of the Champions League final between Juventus and Real Madrid .
The former first citizen of Turin and now vice-president of the M5S expresses bitterness for the decision and attacks: «From the trial it emerges that the Municipality was the only one responsible, the mayors cannot continue to be the scapegoat for everything, from public safety to to the smog ."
And on June 18th there will be the first hearing of the trial which sees the public administrators of Turin and Piedmont who from 2015 to 2019 were accused of negligent environmental pollution in relation to the protection of air quality. Among them are Appendino, Piero Fassino and Sergio Chiamparino. The stoats of the fourth section, after almost eight hours of deliberation, ordered the referral to another panel of the Court of Assizes of Turin to recalculate "in meius" the sentence, which had been 18 months, for the former first small town. The judges have therefore essentially accepted the request of the Attorney General's Office: the reduction of the months of sentence is linked to the withdrawal of numerous complaints and civil party constitutions arrived in recent weeks.
The supreme judges have, however, declared definitive the responsibility of Appendino, currently a parliamentarian of the M5S, for the accusations of disaster, murder and injuries, all cases contested in negligent form. The Court of Cassation also ordered a new appeal process for the former head of the Municipality's cabinet, Paolo Giordana, again for the recalculation of the sentence. Encore appeal also for Maurizio Montagnese, former president of Turismo Torino. The judges, however, definitively acquitted Alberto Bonzano, manager of the Police Headquarters at the time of the events, with the formula "for not having committed the crime". However, the appeal brought by Marco Sgarbi, deputy commander of the traffic police at the time, was rejected. There will, therefore, be a further procedural segment for what happened the night seven years ago in the heart of the Piedmontese capital.
During the projection of the Cup final on a giant screen, a series of waves of panic among the crowd gathered in the square caused 1,500 injuries and the death of two women a few days later . What frightened the tens of thousands of fans present in the square was the action of a gang of robbers (already definitively convicted) equipped with pepper spray. In the reasons for the sentence, the Court of Assizes of Appeal stated that «the organization of the demonstration had been tragically and inexorably conditioned by the shortness of time and by the consequent and unforgivable approximation that characterized the conduct of the individuals, this appears clearly demonstrated by the depositions given by the subjects", who had participated in the meeting held on 26 May and "who gave account of the extreme superficiality of the choices made" also by the designation of the organization organizing the event. For Appendino's defender, lawyer Franco Coppi, the Supreme Court's decision is "particularly severe towards the mayor". «Appendino is attributed responsibility for facts that could hardly have been controlled by her», explains the criminal lawyer.
